It is the RPD or the RAD on appeal who will, in one proceeding, determine whether a claimant is a Convention refugee or a person in need of protection. The jurisdiction of the IRB has been expanded to allow the RPD and the RAD to grant protection on three different basis: 1 a Convention refugee ground, 2 danger of torture, and 3 a risk to life or a risk of cruel and unusual treatment or punishment. The second and third grounds are the basis for finding a claimant to be a person in need of protection. Only the Convention refugee ground need to relate to the person's political opinion, race, religion, nationality or membership in a particular social group.
