Prosecutorial Investigations

An investigation refers to the process of collecting information in order to reach some goal; for example, collecting information about the reliability and performance of a vehicle prior to purchase in order to enhance the likelihood of buying a good car. Applied to the criminal realm, a criminal investigation refers to the process of collecting information or evidence about a crime in order to: 1 determine if a crime has been committed; 2 identify the perpetrator; 3 apprehend the perpetrator; and 4 provide evidence to support a conviction in court. If the first three objectives are successfully attained, then the crime can be said to be solved. Several other outcomes such as recovering stolen property, deterring individuals from engaging in criminal behaviors, and satisfying crime victims have also been associated with the process. A useful perspective on the criminal investigation process is provided by information theory Willmer. According to information theory, the criminal investigation process resembles a battle between the police and the perpetrator over crime-related information. In committing the crime, the offender emits "signals," or leaves behind information of various sorts fingerprints, eyewitness descriptions, murder weapon, etc.

The first police crime laboratory was established in in Lyon, France , by Edmond Locard. That principle gave rise to the forensic sciences, which are the accumulated methods for developing and analyzing physical evidence from crime scenes. Crime-scene investigation, which is often performed by experts known as crime-scene investigators CSIs , involves the careful gathering of such evidence, which is then analyzed at a crime laboratory. In some cases evidence gathered by CSIs and analyzed by forensic experts is the only incontrovertible evidence presented at trial. Because there is rarely more than one opportunity to obtain evidence from a crime scene, the investigation by the CSIs must be methodical and complete. They also take samples of fibres, dirt, and dust. After a preliminary search, the crime scene is photographed; some police departments also make a videotape of the scene.

The forms for use with the Criminal Procedure Rules collect information required by the court for the purposes of criminal case management under the Rules and under other legislation. Each form identifies the Criminal Procedure Rule and any other legislation that the court must apply: see the Rules and that other legislation for details. The information that you give the court will be shared as the law requires, for example with the other parties to the case and you may be required by the Rules and other legislation to give them that information yourself, for example by sending them a copy of the form: see the forms and Rules for instructions. The information that you give the court will not be shared with anyone else or used for any purpose other than the purposes of the case unless that is allowed by law. For example, information is collected by HM Courts and Tribunals Service for statistical purposes and sometimes for the purposes of academic research.

Criminal investigation is an applied science that involves the study of facts that are then used to inform criminal trials. A complete criminal investigation can include searching , interviews , interrogations , evidence collection and preservation, and various methods of investigation. Criminal investigation is an ancient science that may have roots as far back as c. In the code, it is suggested that both the accuser and the accused had the right to present evidence they collected.
